NAFED is a multi-state co-operative society setup with the object of promoting co- operative marketing of agricultural produce to benefit the farmers. NAFED as its principal objectives is engaged in organising, promoting, developing, marketing, processing and storage of agricultural, horticultural and forest produce, distribution of agricultural machinery, implements and other inputs and undertaking domestic and overseas trades.

2.    About the NAFED Website

a.  By accessing/using the NAFED website, you specifically acknowledge and understand that NAFED has invested and continues to invest significant amounts towards the development and maintenance of this website and that any negative feedback/comment/review may cause severe losses to NAFED especially where NAFED has not had the opportunity to address such comment/review. Consequently, in order to prevent such wrongful loss, you, the User specifically agree not to post any negative or disparaging feedback/comment/review whether on this website or on any public domain without first bringing the same to the notice of NAFED.

b. 18.   Governing Law and Jurisdiction
a. These Terms shall be construed in accordance with the Applicable laws of India. In case of any dispute or difference either in interpretation or otherwise, of any terms of these Terms of Use between the parties hereto, the parties shall attempt to resolve the same through discussion. In case the parties fail to arrive at an amiable solution through discussion, the same shall be referred to Arbitration by a Sole Arbitrator at the request of either Party in writing, in accordance with the provisions of Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole Arbitrator to be mutually appointed between the Parties and decision of the arbitrator shall be final and binding on the parties hereto. The seat and venue of arbitration shall be New Delhi, India. The terms of use shall be governed in accordance with applicable Indian Laws. The rights and remedies provided in these Terms are cumulative and are in addition to and not in substitution for any other rights and remedies available at law or in equity.

19.   Modifications to Terms & Conditions
NAFED reserves the right to modify these Terms, at any time, without any prior notification to you personally. If we decide to change the Terms, we will post those changes to this Terms on the home page, and other places we deem appropriate, along with a change notice where we feel that it is necessary which may be communicated to you on this website or through other models of communication. Your use of this website after such notice shall be deemed as acceptance of such changes to these Terms. Please check back frequently to see any updates or changes to these Terms.

20.   General Provisions
a.  If a court or other governmental authority decides that one or more of these Terms are void, invalid or otherwise unenforceable, you agree that the rest of the Terms will remain in effect. Any words following the terms ‘including’, ‘include’, or any similar expression are illustrative and do not limit the sense of the words preceding such expressions.

d.  Notwithstanding anything to the contrary, any separately executed Agreement between NAFED and User shall govern and prevail over these Terms in the event of any conflict.
